I take wrongful death cases personally and I will not let the carrier rush you. The legal process matters, but it is not the first thing.

How a NM Wrongful Death Case Works
NM’s Wrongful Death Act (NMSA §§ 41-2-1 through 41-2-4) provides that a wrongful death claim is brought by a court-appointed personal representative for the benefit of statutory beneficiaries — surviving spouse, children, and (in some cases) parents. The personal representative is often a family member, but the appointment is a court process. Deadline is generally three years from the date of death. Government-defendant cases (Rio Rancho PD, Sandoval County, NMDOT) require written notice within six months of a death (90 days for injury claims) under the NM Tort Claims Act. Federal claims (FTCA) require an administrative claim within two years.
