Albuquerque Wrongful Death Lawyer — Alex Flores at Singleton Schreiber

Can we still recover if my loved one was partly at fault?

Yes. New Mexico is a pure comparative fault state, so a wrongful-death recovery is reduced by the deceased’s share of fault but never barred — even if they were mostly at fault, the family can still recover. Insurers aggressively shift blame onto the person who died; strong evidence pushes back.

If your family lost someone in Albuquerque to a crash, a medical error, a workplace incident, or any other preventable cause, what you’re facing is something a website cannot really prepare you for. The legal process matters — there are claims that need to be brought, deadlines that must be honored, and a financial reality that doesn’t pause for grief — but the work is, first, about being heard. I take wrongful-death cases personally, and I take the time the case needs. I will not rush you, and I will not let the insurance company rush you.

I’m Alex Flores, Senior Counsel at Singleton Schreiber. I served as a Supervisory Assistant U.S. Attorney here in Albuquerque before joining the firm, tried 17 federal jury trials, and have represented many New Mexico families through the wrongful-death process. I’ll explain what’s in front of you in plain language and answer every question.

How a New Mexico Wrongful Death Case Works

New Mexico’s Wrongful Death Act (NMSA §§ 41-2-1 through 41-2-4) provides that a wrongful-death claim is brought by a court-appointed personal representative, for the benefit of the statutory beneficiaries — typically the surviving spouse, children, and in some cases parents. The personal representative is often a surviving family member, but the appointment is a court process and must be done correctly, and handling it is part of what I do at the outset.

The deadline is generally three years from the date of death. If the cause of death involved the City of Albuquerque, Bernalillo County, or another government entity — including UNM Hospital, which is a state institution for many purposes — written notice within six months of a death (90 days for injury claims) may be required under the NM Tort Claims Act. Federal claims under the Federal Tort Claims Act (including the VA Medical Center on Gibson and Indian Health Service facilities) require an administrative claim within two years. Those short windows are a big reason not to wait.

Who Receives the Recovery

New Mexico law directs how a wrongful-death recovery is distributed among the statutory beneficiaries — generally the surviving spouse and children first, and otherwise parents or other next of kin under the statute. The personal representative pursues the claim, but the recovery is for the family. I walk every family through exactly how this works in their situation so there are no surprises later.

Common Causes of Wrongful Death in Albuquerque

  • Motor vehicle crashes. The most common category — fatal collisions on I-25, I-40, the Big-I interchange, Coors, Paseo del Norte, and at major intersections across the city.
  • Commercial truck collisions. Catastrophic by definition — see my New Mexico Truck Accident Lawyer page.
  • Pedestrian and bicycle fatalities. Albuquerque has one of the worst per-capita pedestrian-fatality rates in the country (more below).
  • Drunk-driving deaths. New Mexico’s DWI fatality rate is among the nation’s highest, and these cases often support punitive damages.
  • Medical negligence. Surgical errors, medication errors, missed diagnoses, and failures to monitor at Albuquerque’s hospital systems.
  • Premises and workplace incidents. Falls, equipment failure, negligent security, and OSHA violations.
  • VA Medical Center / Indian Health Service. Federal medical-malpractice claims under the FTCA.

Albuquerque’s Pedestrian-Fatality Crisis

Albuquerque consistently ranks among the most dangerous U.S. cities for people on foot. Wide, high-speed arterials like Central Avenue, Coors, San Mateo, and Zuni see a disproportionate share of fatal pedestrian crashes, often at night and often involving drivers who flee. These cases require fast investigation — surveillance footage, vehicle data, and witness accounts disappear quickly — and they frequently involve uninsured or hit-and-run drivers, which makes uninsured-motorist coverage and prompt legal work critical.

Medical Negligence Deaths at Albuquerque Hospitals

Albuquerque is the medical hub of New Mexico — UNM Hospital (the state’s Level I trauma center), Presbyterian, and Lovelace all serve patients from across the region. When a death results from negligent care — a missed diagnosis, a surgical or medication error, a failure to monitor — a wrongful-death claim may follow. Two wrinkles matter here: UNM Hospital is treated as a state institution for many purposes, which can trigger the 90-day NM Tort Claims Act notice, and care at the VA Medical Center or an Indian Health Service facility falls under the federal FTCA with its two-year deadline. Getting the right deadline right is essential, and it’s exactly the kind of jurisdictional question my background prepares me for.

What a New Mexico Wrongful Death Recovery Includes

  • Reasonable medical, hospital, funeral, and burial expenses
  • Loss of the decedent’s earnings and earning capacity
  • Loss of household services, contributions, and consortium
  • The decedent’s conscious pain and suffering before death
  • Loss of the guidance, counsel, society, and companionship the decedent provided
  • The value of the life itself. New Mexico is distinctive — a jury may award damages for the worth of the deceased person’s life independent of the family’s financial loss, recognizing that a life is worth more than a paycheck.
  • Punitive damages in appropriate cases — particularly where the conduct was reckless, such as drunk driving or willful safety violations

What to Expect

You don’t have to have it all figured out before you call. A first conversation is free, confidential, and carries no obligation. If we work together, I handle the legal machinery — the personal-representative appointment, the investigation, preserving evidence, and dealing with the insurers — so your family can focus on grieving and on each other. There’s no fee unless I recover for you, so cost should never be the reason you hesitate to ask a question.

Where Your Albuquerque Case Will Be Handled

Albuquerque is in Bernalillo County, in the 2nd Judicial District, the busiest court in the state. Serious trauma is concentrated at UNM Hospital, the state’s Level I trauma center. My office is here in Albuquerque, and I represent families throughout the metro and across New Mexico.

Why Alex Flores

I’m a New Mexico native, a former Supervisory Assistant U.S. Attorney in Albuquerque, and Senior Counsel at Singleton Schreiber. I tried 17 federal jury trials and argued — and won — appeals before the Tenth Circuit, and I still serve as a Judge Advocate with the New Mexico Air National Guard. That background matters in cases involving federal facilities and in any case an insurer is determined to fight. For the broader practice context, see my New Mexico Wrongful Death Lawyer page, the Albuquerque Personal Injury Lawyer hub, or my About page.

FAQs: Albuquerque Wrongful Death

Who can bring a wrongful death case in New Mexico?

A court-appointed personal representative brings the claim for the benefit of the statutory beneficiaries — typically the surviving spouse, children, and parents. The representative is often a family member, but the court appointment must be done correctly, and I handle that.

What is the deadline?

Generally three years from the date of death. Government-defendant cases require 90-day written notice under the NM Tort Claims Act, and federal claims require an administrative claim within two years.

What if my loved one was partly at fault?

New Mexico is a pure comparative fault state. The recovery is reduced by the percentage of the decedent’s fault but not barred. Carriers aggressively push fault onto the person who died — a strong case pushes back with evidence.

What if my loved one was a pedestrian killed by a hit-and-run driver?

You may still have a claim through uninsured-motorist coverage even if the driver is never found, and a fast investigation can sometimes identify the driver through surveillance and vehicle data. Albuquerque’s high pedestrian-fatality rate makes these cases sadly common — and time-sensitive.

What if a drunk driver caused the death?

Drunk-driving deaths often support punitive damages on top of compensatory damages because the conduct is reckless. There may also be a separate dram-shop claim if a licensed establishment served the driver alcohol when intoxication was reasonably apparent, under New Mexico’s dram-shop law.

What if my loved one died from medical negligence?

A wrongful-death claim may follow from a missed diagnosis, surgical or medication error, or failure to monitor. Watch the deadline: UNM Hospital can trigger the 90-day NM Tort Claims Act notice, and VA or Indian Health Service care falls under the FTCA’s two-year rule.

What if my loved one died at the VA, Indian Health Service, or another federal facility?

Federal Tort Claims Act rules apply, and you must file an administrative claim within two years. As a former federal prosecutor, I handle these cases directly. See my FTCA page.

What can a wrongful death recovery include?

Medical and funeral expenses, lost earnings and support, loss of guidance and companionship, the decedent’s conscious pain before death, the value of the life itself, and punitive damages where the conduct was reckless.

What is the “value of life” in a New Mexico wrongful death case?

New Mexico is unusual in allowing a jury to award damages for the worth of the deceased person’s life independent of the family’s financial loss — recognizing that a life has value beyond earnings.

Will we have to go to court?

Many wrongful-death cases settle without a trial. If a fair resolution isn’t offered, I’m fully prepared to take the case to a Bernalillo County jury — and that readiness is often what produces a fair settlement.

How much does a wrongful death lawyer cost?

Nothing up front. I work on a contingency fee — no fee unless I recover for your family — and the initial consultation is free and confidential.
