Las Cruces Wrongful Death Lawyer — Alex Flores at Singleton Schreiber

Losing a family member to someone else’s negligence is devastating, and around Las Cruces the causes are often distinctly local — a high-speed crash on I-10 or I-25, a commercial-truck collision involving an out-of-state or cross-border carrier, or a fatal wreck on US-70. It is also a legal emergency: within hours, insurers and corporate defendants deploy investigators to document the scene and build a case against your claim. You need someone moving just as fast for your family.

I’m Alex Flores, Senior Counsel at Singleton Schreiber, and the firm has a Las Cruces office. Before joining the firm I served as a Supervisory Assistant U.S. Attorney in Albuquerque, where I co-led the Indian Country Crimes Section, tried 17 federal jury trials, and argued and won appeals before the Tenth Circuit. I bring that trial discipline, and the firm’s national-firm resources, to families across southern New Mexico.

How long do we have to file a wrongful death claim in New Mexico?

Generally three years from the date of death. But if a government entity is responsible, you may have just 90 days to file a written notice under the New Mexico Tort Claims Act — and if a federal agency caused the death, a separate two-year deadline applies. Do not wait to get advice.

How New Mexico’s Wrongful Death Act Works

New Mexico wrongful death is governed by the Wrongful Death Act, NMSA 1978 §§ 41-2-1 to 41-2-4. The claim must be brought by a court-appointed personal representative of the estate — not directly by grieving relatives — who holds the claim in trust for the statutory beneficiaries (typically the spouse, children, and parents). If no personal representative has been appointed, one must be designated before suit is filed; an experienced attorney handles that as part of the case.

Who Receives the Recovery

Wrongful death proceeds pass to the statutory beneficiaries in a specific statutory order — not through the will and not through probate. A surviving spouse takes one-half and the children take the other half; if there is no spouse, the children share; if there are no children, the spouse recovers; if there is neither, parents (and then siblings) may recover. New Mexico imposes no cap on wrongful death damages.

New Mexico’s “Value of Life” Damages

New Mexico is distinctive: a jury may award the value of the life lost, measured as worth to the person who died, independent of the survivors’ financial losses. The pattern instruction (UJI 13-1830) lets the jury weigh the decedent’s age, health, earning capacity, life expectancy, enjoyment of life, and the relationships and contributions that made up that life. This element exists on top of the survivors’ losses and is frequently the largest component of a New Mexico wrongful death recovery.

Wrongful Death and Survival Actions: Both May Apply

New Mexico recognizes two related claims after a fatal incident. The wrongful death action compensates the beneficiaries for the losses they suffered — lost financial support, lost companionship and guidance, and funeral expenses. The survival action compensates the estate for what the deceased endured before death — conscious pain and suffering, pre-death medical bills, and property damage. When a loved one survived hours or days before dying, the survival-action damages can be substantial. I evaluate both in every case.

Common Causes of Wrongful Death Around Las Cruces

  • High-speed interstate crashes on I-10 and I-25, including the I-10/I-25 interchange — among the deadliest collisions in the region.
  • Commercial-truck fatalities involving long-haul, out-of-state, or cross-border carriers on I-10.
  • US-70 crashes toward Alamogordo and the Tularosa Basin.
  • Drunk-driving fatalities, where a separate dram-shop claim may exist if a licensed establishment served alcohol to someone whose intoxication was reasonably apparent.
  • Medical negligence at regional hospitals.

Why Families Must Act Quickly

There is a race to preserve evidence after every fatal incident — and on I-10 it’s even tighter, because the at-fault truck and its electronic records can leave the state within days. Black-box and ELD data can be overwritten within 72 hours; surveillance footage is recorded over within days; skid marks fade and witnesses scatter. I send preservation letters immediately on being retained and move to lock down the scene, the records, and the electronic data before they’re gone.

What Compensation a Las Cruces Wrongful Death Case Can Recover

Because New Mexico imposes no cap, the full scope of the loss is recoverable, generally in three categories. Economic damages — lost future earnings and benefits, lost household services, and funeral and burial costs. Non-economic damages — loss of companionship, guidance, and society, the grief of survivors, and the decedent’s own conscious pain and suffering before death. Punitive damages — available where the conduct was grossly negligent, reckless, or intentional, such as a drunk driver or a carrier that knowingly ran a fatigued driver. New Mexico’s value-of-life element applies on top of all of this.

Deadlines and Special Situations

  • Three-year statute of limitations. Wrongful death claims must generally be filed within three years of the date of death (NMSA § 41-2-2).
  • 90-day government notice. If a state or local government entity is responsible, the New Mexico Tort Claims Act requires the personal representative to file written notice within six months of the death.
  • Federal Tort Claims Act. If a federal employee or agency caused the death — including military operations around Holloman or White Sands — the claim runs under the FTCA, with a two-year administrative deadline (note that active-duty service members generally cannot sue for injuries incident to service, and federal contractors are sued under state law). See my FTCA page.
  • Out-of-state and cross-border defendants. Where the at-fault carrier is based elsewhere, jurisdiction and insurance can be more complex — another reason to act quickly.
  • Pure comparative fault. Even if the deceased was partly at fault, the family can still recover, reduced by that percentage.

What to Expect When You Hire Me

You’ll work directly with me, not a case manager you never meet. A wrongful death case generally moves from an intake conversation, to immediate preservation letters and investigation, to identifying every liable party and insurance source, to expert work-up (economists, reconstructionists, and medical experts as the facts require), to a demand, and — if the defendants won’t pay fair value — to litigation and trial. There are no upfront costs and no fee unless I recover for your family.

Frequently Asked Questions: Las Cruces Wrongful Death

Who can file a wrongful death claim in New Mexico?

The claim must be brought by a court-appointed personal representative of the estate, not directly by family members. The personal representative holds the claim for the statutory beneficiaries — typically spouse, children, and parents. An attorney handles the appointment.

How long do we have to file?

Generally three years from the date of death (NMSA § 41-2-2). If a government entity is responsible, a 90-day written notice is required under the NM Tort Claims Act, and if a federal agency is involved, a two-year FTCA administrative deadline applies.

What if the at-fault truck was from out of state or crossed the border?

You can still pursue the claim, but it makes fast action critical. The truck and its electronic records may leave New Mexico within days, and out-of-state or cross-border carriers can add layers of insurance and jurisdiction. Preservation letters and early investigation are essential.

What is a wrongful death case worth in New Mexico?

New Mexico imposes no cap. Value depends on the decedent’s age and earnings, the number of dependents, the conduct involved, and the evidence — plus New Mexico’s distinctive value-of-life element.

What are New Mexico’s “value of life” damages?

A New Mexico jury may award the value of the life lost measured to the person who died — considering age, health, earning capacity, life expectancy, and enjoyment of life — independent of the survivors’ financial losses. It is frequently the largest part of the recovery.

Can we bring both a wrongful death claim and a survival action?

Yes. The wrongful death claim compensates the family’s losses; the survival action compensates the estate for the deceased’s pre-death pain and suffering, medical bills, and property damage.

What if the death was caused by a drunk driver?

The driver is personally liable, and if a licensed establishment served the driver alcohol when intoxication was reasonably apparent, a separate dram-shop claim may exist. If the driver was in a company vehicle, the employer may be vicariously liable.

What if a commercial truck caused the death?

FMCSA regulations govern, multiple defendants may be liable, and electronic evidence must be preserved immediately. See my New Mexico Truck Accident page.

Are punitive damages available?

Yes, where the conduct was grossly negligent, reckless, or intentional. New Mexico has no general cap on punitive damages in these cases, though limits apply in medical-malpractice and dram-shop claims, and punitive damages are not available against government defendants.

Can we recover if our loved one was partly at fault?

Yes. Under pure comparative fault, recovery is reduced by the deceased’s percentage of fault but not barred. Insurers routinely inflate that percentage, which an experienced attorney contests with evidence.

How does the contingency fee work?

No upfront costs and no hourly fees. The fee is a percentage of the recovery, and if there is no recovery, you owe nothing. Everything is spelled out in a written agreement before any work begins.
